New legislation on spam

Sending spam or unsolicted commercial e-mail is to become a criminal offence, according to Sandy Adirondack in her latest legal update.

Sandy writes: “From 11 December 2003 it will be an offence, in some situations liable to an unlimited fine, for anyone to send unsolicited commercial email (spam) and text messages to individuals who have not explicitly agreed to this in advance.” They do not cover those with a business e-mail address, she adds.

Sandy gives good advice on what action to take now to ensure compliance with the legislation. She will add a link to the regulations on HMSO Web site once they are published there.
