UK employers must not just allow employees to have a break during the day, they must make sure that they can do so, according to new Department of Trade and Industry (DTI) ./guidance highlighted by Sandy Adirondack in her latest legal update email.

According to Adirondack, the DTI’s ./guidance previously indicated that employers did not have to require workers to take their daily or weekly break entitlement under the Working Time Regulations 1998.

The change in ./guidance followed a ruling on the issue last year in the European Court of Justice. The DTI ./guidance now says that “employers must make sure that workers can take their rest”.
