Hospital escapes liability for accident at fundraising event

Solicitors Sinclair Taylor & Martin are warning charities to check on their fundraising event insurance following a recent ruling.

A fundraising fair organised by the West Hertfordshire Hospitals NHS Trust included a “splat wall” against which people could hurl themselves. Unfortunately one participant was injured.

The resultant court ruling decided that, although the accident happened on a sub-contractor’s equipment, the hospital owed a duty of care under Section 2 of the Occupiers Liability Act 1957 because the accident happened on its lands. Nevertheless, the hospital escaped liability.
