New telemarketing legislation from 25 June 2004

The legislation that allows an individual to opt-out from receiving unsolicited telemarketing calls will be extended to include businesses from 25 June 2004.

From that date it will be an offence to make an unsolicited call to any business that has registered its telephone number with the to the Telephone Preference Service. Breaking this law can be punishable by a £5000 fine, according to Marketingfile.com.

This means that you will no longer be able to make unsolicited calls to any company number that you see on a letterhead or web site, or which is listed on your database, or anywhere else without first checking that it is not opted-out.

Marketingfile.com are using the change in legislation to promote their online TPS checking service. This lets users check numbers before they call. In addition it maintains an audit trail of all numbers checked for users’ additional protection.

Marketingfile.com added that “You will have to be very sure of the cleanliness and recency of any telemarketing data you purchase. This probably rules out all
of the CD-ROM products on the market.”
