UK employers must not just allow employees to have a break during the day, they
must make sure that they can do so, according to new Department of Trade and Industry(
DTI) guidance highlighted by Sandy Adirondack in her latest legal update email.

According to Adirondack, the DTI’s guidance previously indicated that employers
did not have to require workers to take their daily or weekly break entitlement
under the Working Time Regulations 1998.

The change in guidance followed a ruling on the issue last year in the European
Court of Justice. The DTI guidance now says that “employers must make sure that
workers can take their rest”.
